Of Course Apple Is Getting Sued Over the Old iPhone Throttling Fiasco

While there has been speculation that the company has been putting the brakes on aging handsets in a bid to encourage people to upgrade to newer models, Apple says that there's actually a different reason for old iPhones performing less impressively in benchmarks.

For years I told people they were insane for thinking that Apple (NASDAQ: AAPL) was purposely slowing down older iPhones in an effort to force customers to upgrade to a new device. And so it turns out that Apple has been quietly managing power in these older iPhones in order to spare the batteries. Here's what Apple told CNBC on Wednesday: "Lithium-ion batteries become less capable of supplying peak current demands when in cold conditions, have a low battery charge or as they age over time, which can result in the device unexpectedly shutting down to protect its electronic components".

Apple has admitted to deliberately slowing down the operation of older phones to avoid them from shutting down unexpectedly. With a yearly software update, Apple forces the processor of the phone to clock down so that it consumes less battery but also ends up making the phone extremely slow.

The class-action lawsuit filed in IL claims, "the company purposefully and knowingly released operating system software updates to a number of generations of the iPhone in an effort to slow the CPU performance speeds of these devices". Two other lawsuits were filed in California, also Thursday.

They're seeking both California and nationwide class-action certification, which would cover all persons residing in the United States who have owned iPhone models older than the iPhone 8. The pair said they never consented to Apple slowing down their phones. The user wrote about his experience on Reddit, showing that after the battery replacement his phone scored around 2X more points in Geekbench, a benchmark that measures the performance of a processor.

Many iPhone users do not hide their disappointment and anger over Apple's revelation that the corporation intentionally reduces processor speed in "aging" versions of their smartphone line. Why didn't Apple just include an option for throttling on old batteries in these software upgrades?

Apple hasn't responded to the reports of these lawsuits so far. Bogdanovich, like a lot of long-time iPhone owners believes this tactic is a ploy by Apple to convince people to buy new phones.
