Bannon Will Be a No-Present for Home Intel Interview

Schiff's statement also accused the White House of blocking Bannon's testimony, alleging that Bannon's lawyer informed the committee that he would only answer "a set of fourteen yes-or-no questions the White House had pre-approved" regarding the presidential transition, Bannon's tenure in the White House and Bannon's conversations with President Trump after he left.

If Bannon refuses to appear before the House committee, its members could vote to hold him in contempt.

In the meantime, one of the people said, Bannon, the former executive chairman of Breitbart News, has agreed to be interviewed by Special Counsel Robert Mueller, who is leading the investigation into Russian meddling in the election.

U.S. Representative Adam Schiff said the House of Representatives committee's subpoena remained in effect and Bannon's interview has been rescheduled for next week.

"Testifying before the Special Counsel does not obviate Mr. Bannon's obligations under the subpoena issued by the Committee", Schiff said. Representative Mike Conaway, a senior Republican committee member, told reporters on Monday he expected Bannon to comply with a subpoena and answer questions on Tuesday.

Although executive privilege is not a new idea and has been asserted by past presidents, constitutional law professor at University of North Carolina School of Law Michael Gerhardt said only Trump himself can invoke the argument.

Bannon's previous testimony before the committee in January lasted more than 10 hours.

But two sources familiar with the situation said he would not appear, which could leave Bannon facing a charge of contempt of Congress. The people spoke on condition of anonymity because they were not authorized to speak on the record about details of the interview. But he reportedly gave very few answers, even after the committee issued him a subpoena on the spot to compel him to talk.
