Trump administration sues California for its sanctuary state legislation

Trump administration sues California for its sanctuary state legislation

U.S. Attorney General Jeff Sessions will be in Sacramento on Wednesday to "make a major sanctuary jurisdiction announcement", the Department of Justice said.

Eastern time, the Justice Department alleged that three recently enacted California laws obstruct enforcement of federal immigration law and harm public safety.

Carol Leveroni, executive director of the 20,000-member California Peace Officers Association, said they invited Sessions in hopes of gaining clarity on how law enforcement can follow California's sanctuary state law, Senate Bill 54, while still following federal mandates.

"I find it hard to believe even in today's America that informing people of their legal rights could be considered illegal", she said. Last year, California passed laws restricting when local law enforcement officers could cooperate with immigration officials.

Politico reported Tuesday that the suit will focus on three laws passed within the California state legislature a year ago in opposition to President Donald Trump's promised crackdown on undocumented immigration.

In his decision, Judge William Orrick wrote that the case "may help define the contours of the state's broad constitutional police powers under the Tenth Amendment and the federal government's 'broad, undoubted power over the subject of immigration and the status of aliens'".

"I think it's outrageous that a mayor would circumvent federal authorities and put them in danger by making a move such as that", White House Press Secretary Sarah Huckabee Sanders said.

Becerra has proved to be a thorn in the Trump administration's side.

He has pointed to "a disgrace, the sanctuary city situation" and lamented the "protection of these frightful criminals".

Besides the CPOA, other groups involved with the event are the California Police Chiefs' Association, California District Attorneys Association, California State Sheriffs' Association, California Narcotic Officers' Association, and the California Highway Patrol. We have no intention changing that here in California.

President Donald Trump's administration sued California on Tuesday over its sanctuary state policies.

Sessions and the Department of Justice took their own action in January when it sent letters to 23 jurisdictions across the country that receive federal law enforcement grants, threatening subpoenas and grant cuts if those jurisdictions didn't provide proof they are complying with federal immigration rules. The department also plans to seek a court order from a judge to temporarily block the state from enforcing the laws. The third law under federal challenge covers state inspections of detention facilities that hold noncitizens in federal custody.
