Donald Trump loses bid to dismiss accuser's defamation lawsuit

The plaintiff in the lawsuit, Summer Zervos, is a former contestant on Mr. Trump's show "The Apprentice." In her complaint, she said Mr. Trump defamed her during the 2016 presidential campaign by repeatedly describing her accounts, and those of other accusers, as "total lies" and "made up nonsense to steal the election" - potentially for fame or financial gain.

This means that Summer Zervos' complaint will now move forward.

"Nothing in the supremacy clause of the United States Constitution even suggests that the president can not be called to account before a state court for wrongful conduct that bears no relationship to any executive responsibility", Schechter said.

Zervos claimed that Trump kissed her twice on the lips in 2007 in his NY office, "making her 'uncomfortable, nervous and embarrassed, '" when she sought him out for job opportunities and advice after appearing on the show, according to the documents. She cited a United States Supreme Court ruling that allowed Paula Jones to bring a sexual harassment suit against President Bill Clinton.

Zervos said Trump's denials of her accusations amounted to defamation and that being branded a "liar" caused diners to stay away from her restaurant.

The justice said there is nothing in the Supremacy Clause of the U.S. Constitution that precludes a sitting president from being haled into state court for conduct that is not related to his federal duties.

Zervos said Trump sexually assaulted her in his private bungalow at the Beverly Hills Hotel in Los Angeles in 2007.

But she claimed Trump kissed her "very aggressively" and grabbed her breast, and became angry when she rebuffed him.

In the latest indication that the White House is taking a more combative stance toward Special Counsel Robert Mueller's Russian Federation investigation, President Donald Trump has chose to add Washington lawyer Joseph diGenova to his legal team.
