Video shows Harvey Weinstein appearing to fondle businesswoman before alleged rape

A new video of a business meeting between Harvey Weinstein and a woman who has accused him of raping her shows him hitting on the woman and appearing to touch her inappropriately - just hours before the accuser says he raped her in a hotel room.

The video shows Melissa Thompson, one of three women now suing Weinstein for sexual assault, pitching her tech startup to the movie mogul at The Weinstein Company offices in 2011.

While pitching her product, she appeared to make a joke about data being hot right now.

"Defendant moves to dismiss the indictment or counts thereof on various grounds of alleged defect or deficiency in the presentation of the matter to the grand jury", said Cyrus Vance Jr's office on Wednesday in a response to a sprawling and politically charged August 3 motion to dismiss from Weinstein's primary attorney Ben Brafman. In the video, Thompson is polite and friendly with Weinstein, but at one point he reportedly touched her leg off-camera.

Melissa Thompson is one of the three women who filed a class-action lawsuit against Weinstein in June, accusing him of uninvited sexual conduct in various forms.

Instead, she alleges, he lured her to his hotel room, where he raped her.

According to Sky News, who first obtained the footage, Weinstein arrived alone to the meeting and told his staff "don't interrupt".

After quickly agreeing to use the technology to promote his movies, Thompson said Weinstein put his hand up her dress. "Brafman says, ". the video, when viewed in its entirety, in context and not in select excerpts, demonstrates that there is nothing forceful, but casual - if not awkward - flirting from both parties".

"We believe that the People's response in its entirety makes it absolutely clear that the case against Mr. Weinstein can not be successfully prosecuted", said Brafman in a statement to Deadline.

Claiming that the video tried to malign Weinstein for financial gain, Barfman said facts mattered. "How did I get myself here?" she added. I constantly felt trapped, no matter where I turned. Weinsten has denied all nonconsensual sexual contact. They said the secret grand jury documents provided to the judge were enough to show they presented evidence "fairly and in a manner that was not misleading".

The two other women in that specific lawsuit claim Weinstein battered and assaulted them in hotel rooms during incidents dating back to the nineties.
